Addendum on Generative AI-powered Features

Article 1 (Scope and Priority)

This Addendum applies to features, tools, applications, and services, which are included in the Service defined in and provided under the Terms of Use to which this Addendum is attached ("Terms of Use"), that use machine learning or other artificial intelligence technologies to automatically create, process, or transform information, text, images, layouts, answers, or other contents ("Generative AI-powered Features").

If there is any conflict between this Addendum and the main Terms of Use, this Addendum will take priority for matters related to your use of the Generative AI-powered Features.

Article 2 (Disclaimer of Warranty and Responsibility of Use)

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CANON EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF ACCURACY, COMPLETENESS, LAWFULNESS, USEFULNESS, REPRODUCIBILITY, OR FITNESS FOR A PARTICULAR PURPOSE OF ANY CONTENT CREATED, PROCESSED, OR PRESENTED BY THE GENERATIVE AI-POWERED FEATURES ("Outputs").

The Outputs may contain inaccuracies, incomplete information, bias, or inappropriate expressions. Further, the Outputs are provided for reference only and do not constitute professional advice, including technical, legal, business, or other expert advice.

You use the Generative AI-powered Features at your own risk and with an understanding of the preceding two sections, and you are solely responsible for any consequences arising from your use, adoption, or sharing of the Outputs with third parties.

Article 3 (Transparency and AI marking)

Canon may clearly indicate or notify you, in accordance with applicable laws and in a reasonable manner, that the Outputs were generated or processed using generative AI technologies.

Do not modify, remove or hide any AI-related indicator or notice provided by Canon pursuant to the preceding section, including when you share content created using the Generative AI-powered Features with third parties or make such content open to the public.

Article 4 (Special Provisions on Prohibited Activities)

When using the Generative AI-powered Features, you agree that you shall not:

(1) use the Outputs in a way that misleads others into believing they were created by a human;

(2) make the Outputs available to the public in a manner that enables unspecified or multiple third parties to access or obtain such Outputs, including by posting, publishing, transmitting, or otherwise sharing the Outputs by electronic means;

(3) infringe on copyright, privacy or any other rights or interests of third parties;

(4) use the Generative AI-powered Features to encourage discrimination, hate, violence, or illegal activities;

(5) intentionally create or spread false or misleading information;

(6) use the Generative AI-powered Features for unlawful or unethical purposes;

(7) analyze, decompile, or reverse engineer AI models or systems;

(8) perform prompt injection or other fraudulent or abusive manipulations;

(9) use the Generative AI-powered Features in ways that Canon reasonably considers inappropriate from the perspective of the purpose of the Generative AI-powered Features or social responsibility; or

(10) engage in any other prohibited activities specified in the Terms of Use.

Article 5 (Special Provisions on Copyright and Intellectual Property)

CANON MAKES NO WARRANTY THAT THE OUTPUTS AND THEIR USE WILL NOT INFRINGE THE INTELLECTUAL PROPERTY RIGHTS (INCLUDING COPYRIGHTS) OR OTHER RIGHTS OF THIRD PARTIES.

If you use third party's text, images, layouts, or other content as Inputs to, or for analysis, revision, reconfiguration, or printing through, the Generative AI-powered Features, you are fully responsible for such use.

Canon is not responsible for any disputes, claims, or damages arising between you and third parties in relation to the preceding section.

Article 6 (Use of Third-Party AI Tools)

Canon may use generative AI tools provided by third parties ("Third-Party AI Tools") to provide the Generative AI-powered Features.

When using the Generative AI-powered Features, you shall comply with the terms, policies, and other conditions set by third-party providers of Third-Party AI Tools ("Third-Party Terms").

The Third-Party AI Tools and applicable Third-Party Terms as of the time of the last update of this Addendum are listed in the Appendix. Canon may, at its sole discretion and without any notice, update this list.

Canon is not responsible for limitations or outcomes caused by the specifications, service conditions, or legal compliance status of the Third-Party AI Tools.

Article 7 (Handling of Inputs)

You agree that, to the extent necessary to provide the Generative AI-powered Features, your input data or other information you provide through the Generative AI-powered Features ("Inputs") may be transmitted to and processed by third-party providers of the Third-Party AI Tools.

You warrant that you have the lawful right to input any Inputs into the Generative AI-powered Features.

If you input personal or confidential information into the Generative AI-powered Features, you do so at your own risk. Do not input sensitive personal information.

Canon may use Inputs, Outputs and any information generated by your use of the Generative AI-powered Features to improve quality, ensure safety, provide user support, and for other purposes described in the applicable Privacy Policy.

Article 8 (Changes, Suspension, or Limitations)

Canon reserves the right to modify, suspend, or limit the content, specifications, performance, or availability of the Generative AI-powered Features at any time, at its sole discretion, without prior notice to you.

Due to technical developments, legal requirements on generative AI technologies, or changes in the Third-Party AI Tools, the quality or characteristics of Outputs may change.

Use of the Generative AI-powered Features may be temporarily restricted due to usage limits or other restrictions imposed by third-party providers of the Third-Party AI Tools.

Appendix (Third-Party AI Tools and Their Terms)

The following is a list of the Third-Party AI Tools and those service providers, along with the applicable Third-Party Terms:
